When a dispute results in a courtroom trial, there will be a winner and a loser.  The decision is made by a judge or jury who does not know the parties, likely has no background in the subject matter of the dispute and thus may not fully understand the dispute, and who will never feel the consequences of their decision.

There are no losers when a dispute is resolved with mediation.  While the parties may not get everything they hoped for, mediation results in a settlement of all issues that each party can live with.
